(1) National system


The Croatian system of workers’ participation in decision-making is twofold: on the one hand, there are regulations on workers’ involvement through works councils and board-level participation, and on the other, there are provisions on trade union organisations. Given the range of rights granted to workers in Croatia it may be categorised as having strong participation rights, including collective and individual rights.


Both forms of workers’ association and involvement are regulated in the Labour Act (Zakon o radu, ‘Narodne novine’, No. 38/95, etc.), which was adopted in 1995 and has since been amended several times, notably in the last few years as Croatia started to incorporate EC directives in the national legal system.


Works council

First, workers have the right to elect, in free and direct elections, by secret ballot, one or more representatives (the works council) who shall represent them before their employer in relation to the protection and promotion of their rights and interests. The procedure for the establishment of a works council is initiated upon the proposal of a trade union or at least 10% of the workforce (see Art 140).

Workers' representatives on the supervisory board

According to Article 166 a worker's representative must sit on the supervisory board or other corresponding body of an enterprise with more than 200 workers, or which is more than 25% owned by the Republic of Croatia or by a unit of local or regional self-government, as well as in public institutions, regardless of the number of workers employed in the enterprise or institution concerned.

Workers' representatives on the supervisory board are appointed and recalled by the works council. If no works council has been established at an employer, the workers' representative is appointed as member of the supervisory board and recalled by the workers, by direct and secret ballot, in the manner prescribed by the Labour Act for the election of a one-member works council.

The member of the supervisory board appointed by the employees has the same legal position as other appointed members of the supervisory board.
